Subscription and Payment

Datainize offers various subscription plans. By selecting a subscription plan and providing payment information, you agree to the following terms:

Billing

You agree to pay all fees associated with your chosen subscription plan. Fees are non-refundable except as required by law or as explicitly stated in these Terms. Subscription fees are charged at the beginning of your subscription period and will automatically renew unless you cancel your subscription before the renewal date.

Price Changes

Datainize reserves the right to change subscription fees at any time. We will notify you of any fee changes before they become effective. Your continued use of our services after a fee change constitutes your agreement to pay the modified fee amount.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation, your subscription will remain active until the end of your current billing period, after which it will not renew.

Intellectual Property

Our services and all materials therein, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, and music, are owned by or licensed to Datainize and are protected by intellectual property laws.

License to Use

Subject to your compliance with these Terms, Datainize grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use our services for your personal or internal business purposes. This license does not include the right to collect or harvest any data from our services, reproduce, distribute, or create derivative works based on our services without prior written consent from Datainize.

Your Content

You retain ownership of any content you submit to our services. By submitting content to our services, you grant Datainize a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with providing our services to you.

Limitation of Liability

To the maximum extent permitted by law, Datainize and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use our services.
• Any conduct or content of any third party on our services.
• Any content obtained from our services.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability to you for all claims exceed the amount you paid to Datainize for the services during the twelve (12) months preceding the event giving rise to the liability.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Datainize does not warrant that:

• Our services will function uninterrupted, secure, or available at any particular time or location.
• Any errors or defects will be corrected.
• Our services are free of viruses or other harmful components.
• The results of using our services will meet your requirements.

Indemnification

You agree to defend, indemnify, and hold harmless Datainize and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to our services.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your content caused damage to a third party.

Termination

Datainize may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use our services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law
